A partir del estudio de sentencias recientes, se examinan los requisitos exigidos para configurar esta causal, particularmente la gravedad de la conducta, su imputabilidad y la necesidad de que torne intolerable la vida en común. Se observa que la reanudación de la convivencia matrimonial posterior a la conducta imputada constituye un elemento relevante para descartar la causal, al debilitar la afirmación de que la vida común se volvió intolerable. Asimismo, se estudian las dificultades probatorias propias de este tipo de conflictos, derivadas del carácter reservado de las conductas y de la posible exclusión de medios de prueba por afectación de derechos fundamentales, especialmente la intimidad y la inviolabilidad de las comunicaciones. Se concluye que la jurisprudencia tiende a adoptar una concepción amplia del deber de fidelidad, que trasciende la exclusividad sexual e incorpora dimensiones de confianza, lealtad y vínculo afectivo entre los cónyuges.Examines the judicial interpretation of fault-based divorce grounded on the breach of the marital duty of fidelity, with particular attention to the criteria applied by courts when determining whether the action should be granted or dismissed. Based on an analysis of recent case law, the study reviews the requirements for establishing this ground for divorce, particularly the seriousness and imputability of the conduct and the requirement that it render married life intolerable. It shows that the resumption of marital cohabitation after the alleged misconduct is a relevant factor in rejecting the claim, as it weakens the argument that continued cohabitation had become intolerable. The study also addresses the evidentiary difficulties inherent in these disputes, arising from the private nature of the conduct and from the possible exclusion of evidence obtained in violation of fundamental rights, particularly privacy and the confidentiality of communications.
