Se revisan inicialmente conceptos vinculados con las tecnologías de registro distribuido, blockchain, bitcoin y las distintas categorías de criptoactivos, con especial atención a las criptomonedas. A partir de ello, se examina su posible consideración como bienes incorporables al patrimonio y, en consecuencia, susceptibles de transmisión hereditaria. El análisis identifica como principal dificultad práctica el acceso a las claves privadas que permiten disponer de estos activos, cuya pérdida puede impedir de manera definitiva su recuperación por los herederos. Se estudian distintas alternativas para incorporar dichas claves o mecanismos de acceso en la planificación sucesoria, considerando tanto disposiciones testamentarias como soluciones tecnológicas y servicios especializados. Se concluye que, aunque los criptoactivos pueden integrar el patrimonio transmisible del causante, sus características tecnológicas plantean desafíos particulares para el derecho sucesorio y hacen necesario prever mecanismos adecuados que garanticen su identificación, acceso y efectiva transferencia a los herederos.Examines the transfer of crypto-assets upon death, focusing on the legal difficulties arising from their digital nature and from the technological mechanisms used for their administration and disposal. It first reviews concepts related to distributed ledger technologies, blockchain, bitcoin, and the different categories of crypto-assets, with particular attention to cryptocurrencies. On this basis, it considers whether these assets may form part of an individual's estate and therefore be transferred to heirs. The analysis identifies access to private keys as one of the main practical difficulties, since their loss may permanently prevent heirs from recovering or disposing of the assets. Different alternatives for incorporating access credentials and related mechanisms into estate planning are examined, including testamentary arrangements, technological solutions, and specialized services.
